Terms of Service: Slotted UpBright®

OVERVIEW > Welcome to Slotted UpBright! The terms “we”, “us” and “our” refer to Slotted UpBright. Slotted UpBright operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Slotted UpBright is powered by Shopify, which enables us to provide the Services to you.

SECTION 1 - ACCESS AND ACCOUNT > By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. You are solely responsible for maintaining the security of your account credentials and for all account activity.

SECTION 2 - OUR PRODUCTS > We have made every effort to provide an accurate representation of our products. All descriptions of products, including the Integrated Edgelit SEG Retail System, are subject to change at any time without notice. We reserve the right to discontinue any product or limit quantities at our sole discretion.

SECTION 3 - ORDERS AND EXPORTS > When you place an order, you are making an offer to purchase. Your order is not accepted until Slotted UpBright confirms acceptance. While we primarily sell to commercial entities, you agree that any export of our products is subject to the customs and import laws of the destination country (including but not limited to the UK, Europe, USA, Dubai, and Australia).

SECTION 4 - PRICES AND BILLING > Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, or international customs and import charges. You are responsible for all such additional fees.

SECTION 5 - SHIPPING AND DELIVERY > Once we transfer products to the carrier, title and risk of loss passes to you. All delivery times are estimates only. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control.

SECTION 6 - INSTALLATION AND SAFETY (KIT PRODUCTS) > The Integrated Edgelit SEG Retail System is sold as a kit designed for an easy install by the customer.

  1. Instructions: You agree to install the kit strictly in accordance with the provided instructions and the Operation & Maintenance (O&M) Manual.

  2. Tools & Cables: You acknowledge that this system is not "tool-free" or "cable-free" and requires standard tools and the management of integrated cables for a secure installation.

  3. Responsibility: It is the buyer’s responsibility to ensure the installation is performed safely. While we may recommend a qualified electrician for the final connection, this is at your discretion provided you follow the provided instructions, unless mandated otherwise by your local laws.

  4. Environment: You must ensure the system is maintained in the environment and conditions specified in the O&M manual. Slotted UpBright is not liable for failures caused by improper environmental conditions.

SECTION 7 - WEEE COMPLIANCE AND DISPOSAL By purchasing the Integrated Edgelit SEG Retail System, the buyer acknowledges that the product is classified as Electrical and Electronic Equipment (EEE) and is subject to the Waste Electrical and Electronic Equipment (WEEE) Regulations.

  1. Transfer of Responsibility: In accordance with the WEEE Regulations (including the UK WEEE Regulations 2013, as amended), Slotted UpBright and the Buyer hereby agree that the responsibility for the financing, collection, treatment, recovery, and environmentally sound disposal of the product at its end-of-life is transferred entirely to the Buyer.

  2. Compliance: The Buyer agrees to dispose of all electrical components of the system through an Authorized Treatment Facility (ATF) and to maintain records of such disposal in accordance with local environmental laws.

SECTION 8 - INTELLECTUAL PROPERTY > Slotted UpBright® is a registered trademark. All content, including text, images, and product designs, is owned by Slotted UpBright and protected by international copyright and intellectual property laws. You must not reproduce, modify, or transmit any material from this site without our prior written consent.

SECTION 9 - DISCLAIMER OF WARRANTIES > EXCEPT AS EXPRESSLY STATED BY SLOTTED UPBRIGHT, THE SERVICES AND ALL PRODUCTS, INCLUDING THE INTEGRATED EDGELIT SEG RETAIL SYSTEM, ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE. WE DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT FAILURE TO FOLLOW THE O&M MANUAL WILL NOT RESULT IN PRODUCT MALFUNCTION.

SECTION 10 - LIMITATION OF LIABILITY > TO THE FULLEST EXTENT PROVIDED BY LAW, SLOTTED UPBRIGHT SHALL NOT BE LIABLE FOR ANY INJURY, LOSS, OR DAMAGE ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PROCURED, INCLUDING ANY FAILURES RESULTING FROM INSTALLATIONS THAT DEVIATE FROM OUR PROVIDED INSTRUCTIONS. OUR TOTAL LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCT.

SECTION 11 - INDEMNIFICATION > You agree to indemnify Slotted UpBright from any claims or losses arising out of your breach of these Terms, your violation of any law, or your improper installation of the Integrated Edgelit SEG Retail System.

SECTION 12 - GOVERNING LAW > These Terms shall be governed by and construed in accordance with the laws of England and Wales. You consent to the exclusive jurisdiction of the courts located in England for any disputes arising under these Terms.

SECTION 13 - USA SPECIFIC: ARBITRATION & CLASS ACTION WAIVER > For customers located in the United States: Any dispute arising from these Terms or the use of our products shall be settled by individual, binding arbitration. You and Slotted UpBright waive the right to a trial by jury or to participate in a class-action lawsuit.
